MAKERS MARKET VENDOR TERMS & LIABILITY WAIVER

Please review the following terms carefully. You must accept this agreement to submit your vendor application form later.

  1. Vendor Status & Setup
    The Vendor participates as an independent entity. You are solely responsible for your own booth setup, sales, tax collection, and compliance with all Minnesota laws and local regulations.

  2. Assumption of Risk (Property & Inventory)
    The market environment carries inherent risks, including exposure to weather, theft, accidental damage, or loss of property. The Vendor voluntarily assumes all risks associated with their inventory, equipment, displays, and personal belongings. The Market Organizer does not provide security for individual booths or guarantee the safety of vendor property.

  3. Release of Liability
    To the fullest extent permitted by Minnesota law, the Vendor hereby releases, waives, and forever discharges the Market Organizer, its officers, directors, employees, volunteers, and the venue property owners from any and all liability, claims, or demands arising out of ordinary negligence causing any injury, property loss, or damage to the Vendor or the Vendor's staff during the event (including setup and teardown).

  4. Indemnification & Product Liability
    The Vendor agrees to defend, indemnify, and hold harmless the Market Organizer from any and all claims, damages, losses, or lawsuits (including attorney's fees) arising out of:

  • The Vendor’s booth operations, setup, or negligence within their assigned space.

  • Any health, safety, or liability claims related to products, food, or goods sold or distributed by the Vendor.

  1. Governing Law
    This agreement is governed by and construed under the laws of the State of Minnesota. If any portion of this agreement is held invalid, the remaining portions will continue in full legal force.
